GEOGRAPHICAL INDICATORS AND NAMES OF ORIGIN
Geographical indicators
Geographical indications and designations of origin, used in trade to indicate the geographical origin of products, are protected by the law on industrial property and bylaws issued implementing it.
“Designation of origin” is the name that identifies a product:
- Originating from a specific country, region or, in special cases, a state;
- Whose qualities or characteristics come, exclusively or essentially, as a result of a particular geographical environment, which includes natural and human factors, inherited from that environment;
- The steps for the production of which are realized in the defined geographical area.
"Geographical indication" is the name that identifies a product:
- Originating in a specific country, region or country;
- The qualities, reputation or other characteristics of which are essentially attributed to its geographical origin;
- At least one of the productive steps of which is realized in the defined geographical area.
In the case of applications relating to alcoholic beverages, the geographical indication of an alcoholic beverage shall be an indication identifying an alcoholic beverage originating in the territory of a country or a region or locality of that territory, where a given quality, the reputation or other characteristics of that alcoholic beverage are essentially attributed to its geographical origin.
In the case of wine-related applications:
